Terms and Conditions

Your use of the Lemon app (the “App”) is subject to the terms of this legal agreement between you and Playhill Limited, a company organised and existing under Maltese law, registration number C 99597, with registered office at Pyketree Business Centre, Suite 2, Office 4, Santa Venera, CBD 5030, Malta, VAT number MT28384806, as amended from time to time (the “Terms of Service”).

These Terms of Service, along with our Privacy Policy, any mobile licence agreement, and other posted guidelines within our App (collectively, “Legal Terms”), constitute the entire and only agreement between you and Playhill Limited, and supersede all other agreements, representations, warranties and understandings with respect to our App and the subject matter contained herein. We reserve the right to amend the Legal Terms at any time, without specific notice to you. You should review all Legal Terms prior to using our App. After any revisions to our Legal Terms are posted, you agree to be bound to any such changes to them. Therefore, it is important for you to periodically review our Legal Terms to make sure you still agree to them. By using our Service (as defined below), you agree to fully comply with and be bound by our Legal Terms. Please review them carefully. If you do not accept our Legal Terms, do not access and use our App. If you have already accessed our App and do not accept our Legal Terms, you should immediately discontinue use of our App.

Definitions

The terms “us” or “we” or “our” refer to Playhill Limited, the owner of the App. A “User” is an individual that has registered with us to use our Service. Our “Service” represents the collective functionality and features as offered through our App to our Users. All text, summaries, and data offered through our App are collectively known as our “Content” (excluding original third-party articles and RSS feeds, which remain the property of their respective authors or publishers).

Services

The App provides Users with personalised news feeds by aggregating publicly available RSS feeds from various publishers, featuring:

  • AI-generated summaries based on the ChatGPT model, displaying headlines, summaries, and links to original content; and
  • Ad-free functionality for subscribed Users.

The App does not host or store original news articles and ensures all linked content directs Users to the original publishers.

AI-Generated features

Our App’s summarisation functionality is powered by an AI model that processes publicly available from RSS feeds. This feature is designed to enhance user experience by offering concise summaries of news articles. Please note the following:

  • Automated process: summaries are generated by an AI model (ChatGPT) using algorithms designed to condense content. As these summaries are automated, Playhill Limited does not manually verify their content.
  • Limitations: summaries may not fully represent the original articles and could contain inaccuracies, omissions, or interpretations that differ from the original content. Users are advised to consult the linked original articles for full and accurate information.
  • Impartiality disclaimer: while the AI model is designed to operate impartially, we cannot guarantee that generated summaries will always avoid bias or reflect all viewpoints of the source material.
  • Informational purposes: AI-generated summaries are provided for general informational purposes only and should not be relied upon as a definitive interpretation of the source content.
  • Use at your own risk: Users acknowledge that they bear sole responsibility for how they interpret and use AI-generated summaries provided by the App.

Users are encouraged to report any perceived inaccuracies, errors, or concerns regarding AI-generated summaries at [email protected]. This feedback helps us improve the quality of our AI services over time.

Links to other websites and apps

Our App contain links to third-party websites or apps that are provided solely as a convenience to you. By linking to these links, you acknowledge and agree to the following:

  • No affiliation: we do not create, endorse, or have any formal association with third-party websites or apps, unless expressly stated.
  • No responsibility: we are not responsible for the accuracy, legality, reliability, or decency of any third-party websites or apps accessed through the App.
  • Use at your own risk: your use of third-party websites or apps is at your own discretion and risk. It is your responsibility to review the terms of service, privacy policies, and other applicable terms of the linked websites or applications.
  • No liability: we disclaim any liability for the accuracy or impartiality of AI-generated summaries; content hosted on third-party websites and apps accessed via the App; any direct, indirect, consequential and/or incidental damages resulting from the use of the App or linked content. Users are solely responsible for their interpretation and use of summaries provided by the App.

Users are encouraged to report any third-party websites or apps that may be inappropriate, illegal, or infringing at [email protected]. We will investigate the matter in accordance with applicable laws.

Advertising and Subscriptions

Our Service is currently provided as a free version supported by ads displayed within the App. At this time, there are no paid subscription options available. Should this policy change in the future, we will update these Terms of Service accordingly.

Privacy and Data Usage

We value your privacy and complies with the General Data Protection Regulation (Regulation (EU) 2016/679, of the European Parliament and of the Council, of 27/04/2016), as amended from time to time. For full details, please refer to our Privacy Policy.

Copyright and Intellectual Property

We use publicly available RSS feeds. All rights to the original content belong to the respective authors or publishers. We include attribution and links to the source where required. If you believe your copyrighted material is being used improperly, please contact us at [email protected].

Our App may contain our service marks or trademarks as well as those of our business partners and other companies, in the form of words, graphics, and logos. Your use of our App does not constitute any right or licence for you to use such service marks/trademarks, without the prior written permission of the corresponding service mark/trademark owner. Our App is also protected under international copyright laws. The copying, redistribution, use or publication by you of any portion of our App is strictly prohibited. Your use of our App does not grant you ownership rights of any kind in our App.

Force Majeure

We shall not be held liable for failure to perform or delays due to an act of God or other circumstances beyond its reasonable control, including, but not limited to, acts of fire, flood and violence, epidemic or pandemic, war, threat of war, strikes, government actions, internet unavailability, technical failures, or similar events.

User responsability

We reserve the rights to block access or completely remove User accounts if we find out that the App is used in abusive manner. This includes, but is not limited to the following:

  • Automated registrations for SPAM, SCAM, SEO boosting and other similar purposes;
  • Subscribing to the same feed from multiple accounts to boost its subscriber count;
  • Using our platform to send unsolicited emails or collect/distribute illegal content; constantly trolling and abusing our comments function;
  • Subscribing to large number of similar feeds from the same provider that might be considered abusive by the third party.

When using the App, you agree to:

  • >Use the App only for lawful purposes and in compliance with our Legal Terms;
  • Not interfere with or disrupt the App’s functionality;
  • Report inaccuracies, errors, or concerns in good faith using the in-app reporting tools;
  • Refrain from attempting to reverse engineer the App or its AI models.

Termination

Either party may terminate this Agreement in their sole discretion, at any time with or without cause and regardless of the stated registration period otherwise applicable. We reserve the right to suspend or terminate operation of the App, or any feature of the App, at any time upon notice.

General Terms

Our Legal Terms shall be treated as though it were executed and performed in Malta, and shall be governed by and construed in accordance with the laws of Malta, without regard to conflict of law principles. In addition, you agree to submit to the personal jurisdiction and venue of such courts. Should any part of our Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content in our App conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence. Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under our Legal Terms shall survive the termination of our Legal Terms.
